No! The person is an illegal alien and usually they lay low and stay out of trouble or there are deported back to their own country because they are in the U.S. illegally. By going to court it would be like putting your own handcuffs on!
As odd as it may seem, an illegal immigrant may sue a US citizen or another immigrant in most US state courts, not however, a federal court.
The reason this is possible is there are no state laws preventing the action and state's do not have jurisdiction over illegal immigrants, that belongs to the UCSIS and ICE.
Several states are begining to enact legislation that would related to what legal rights an illegal immigrant has concerning lawsuits, housing, education and so forth.
