Good evening. If your wife has a Conditional Green Card that expires in two years she is required to file form I-751 within 90 days of the expiration date. I have attached Form I-751 and the instructions. She will also have to submit evidence for bona fides of marriage to prove that your marriage is based on your relationship and not just to obtain an immigration benefit. I have attached a list of evidence she can submit for bona fides of marriage. The more evidence she submits the stronger her application will be. If she becomes a U.S. citizen before her Green Card expires she will not have to file Form I-751. In that case she should notify USCIS that she is not filing Form I-751 because she has become a citizen and then follow any instructions from USCIS.
1. Since you have orders to Japan your wife can apply for expedited naturalization as soon as she becomes a permanent resident. She will have to complete and file a naturalization application (N-400).
The qualifications are
• Age 18 or older at the time of filing.
• LPR at the time of filing the naturalization application.
• Continue to be the spouse of the U.S. citizen up until the time the applicant takes the Oath of Allegiance.
• Married to a U.S. citizen spouse regularly stationed abroad in qualifying employment for at least one year.
• Has a good faith intent to reside abroad with the U.S. citizen spouse upon naturalization and to reside in the United States immediately upon the citizen spouse’s termination of employment abroad.
• Establish that he or she will depart to join the citizen spouse within 30 to 45 days after the date of naturalization.[3]
• Understanding of basic English, including the ability to read, write, and speak.
• Knowledge of basic U.S. history and government.
• Demonstrate good moral character for at least three years prior to filing the application until the time of naturalization.[4]
• Attachment to the principles of the U.S. Constitution and well-disposed to the good order and happiness of the U.S. during all relevant periods under the law.
2. If she does not file for expedited naturalization she can go to Japan with you after receiving her Green Card. She will be eligible to apply for overseas naturalization after she has been a permanent resident for 3 years. Please let me know if you have any questions.
