리테일 매장을 운영하고 있습니다. 자바 홀세일업체에서 약 2주전 매장에서 판매할 의류제품을 구매후 판매하고있습니다.. 그런데 특정 브랜드가 지적재산권 침해했다며 이메일을 보냈습니다. 그들이 몰래 저희 매장에서 찍어간 사진들을 보니 그들 제품과 거의 비슷하더군요. 유명 홀세일 업체에서 브랜드제품을 카피해서 판매할줄 알면서 구매를 했겠습니까? 다행히 구매 벌수는 많지 않아 다합쳐 9벌 정도입니다만. 어떻게 대응해야 할지 이런경우가 처음이라 당황스럽습니다. 우선 제품들은 매장에서 수거하여 판매는 하지 않고있습니다. 받은 이메일 내용은

Intellectual property infringement
I write on behalf of Zimmermann Wear Pty Ltd and its related entities (Zimmermann).
Zimmermann
As you may know, Zimmermann is a luxury Australian fashion brand with its own retail stores
around the world, including 19 currently in the USA, as well as online stores and a number of
wholesalers. Zimmermann makes a significant investment in its intellectual property and takes
the protection of it extremely seriously.
Intellectual property
Zimmermann owns copyright in its original fabric artwork, embroidery, lace and trims which are
created by its in-house team of artists and designers. That copyright arises automatically in
Australia and is recognised in Berne Convention countries around the world, including the
United States of America.
Copyright in Zimmermann’s original fabric artwork is infringed when it is, in summary,
reproduced, imported, offered for sale or sold, without authorisation from Zimmermann.
Zimmermann is entitled to remedies for infringement of its intellectual property, including an
injunction, an account of profits, damages and punitive damages.
Your unlawful conduct
1. It has come to our attention that you are advertising for sale, and selling, copies of
Zimmermann’s original garments including in your physical store located at Westfield
Century City 10250 Santa Monica Blvd Level 2 Los Angeles CA 90067 (the Copied
Garments).
Non-exhaustive examples of the Copied Garments are set out in Annexure A. This conduct is
an infringement of Zimmermann’s intellectual property.
Your unlawful conduct is of a very serious nature, and a clear and flagrant infringement of
Zimmermann’s copyright in respect of its original fabric artworks. Your infringements are
extensive, deliberate and for commercial gain. Your conduct is occurring in LA which is a
commercially significant jurisdiction to Zimmermann, and we are particularly concerned that
you are operating stores in extremely close proximity to our Melrose Avenue boutique.
Accordingly your promotion and sale of the Copied Garments has the potential to damage
Zimmermann commercially.
Zimmermann will not tolerate such flagrant infringement of its intellectual property rights in such
aggravated circumstances. Should Zimmermann be forced to take legal action against you, we
intend to seek all remedies and penalties available under the law including punitive damages.
We also expect that your landlords would not tolerate the sale of copied or counterfeit garments
from its premises.
Demands
We demand that by no later than 9am on Wednesday 24 August 2022, you:
1. remove all Copied Garments from your physical store, and from any website, social
media or other location they appear;
2. provide detailed information on the style and numbers of Copied Garments in your
possession;
3. deliver up every Copied Garment to an address to be provided by Zimmermann;
4. provide an invoice(s) showing the details of your purchase(s) of the Copied Garments;
5. provide a written undertaking to Zimmermann Wear Pty Ltd that includes:
a. a detailed explanation of where the Copied Garments were sourced, including
the full contact details and address of the person(s), business(s), website(s)
or factory(ies);
b. an undertaking, which includes your full name and identifying information
(including your date of birth and address), that you will not use Zimmermann’s
copyright material, trade marks, designs or photographs in the future, without
express authorisation of Zimmermann; and
c. details of all sales of Copied Garments made by you to date. This should
include identifying information for each product, the number sold, the price at
which it was sold, and the price at which you purchased it.
If you do not comply with these demands within the timeframe required, Zimmermann intends
to take further steps against you to protect its intellectual property.
Zimmermann reserves all its rights.
