IRS가 실수를 인정하고 돈을 돌려달라고 가이드라인을 발표는 했어요. 하지만 돌아가신 어머님 앞으로 배달된 체크를 돌려드려야 할 법적인 조항은 없는 상태입니다. 많은 사람들이 이미 다 썼고요. 그래서 실질적으로 IRS도 Return을 안하는 체크를 다시 돌려받기는 어렵다고 판단하고 있습니다.
체크를 다시 돌려 보낸 후 아버님의 배당액수만 돌려받으시려면 시간이 길게 걸립니다. 그러니 혹시 은행에 디파짓이 가능하다면(Joint acct 가 아니면 안될 수도 있어요) 먼저 디파짓 하시고 난 후 어머님의 배당액수를 머니오더나 개인체크로 돌려보내셔도 됩니다.
저는 개인적으로 체크가 클리어 될 수 있으면 그 돈으로 꽃을 사서 가족분들과 함께 돌아가신 어머님을 찾아뵙기를 원합니다. 나머지는 얼마 안되지만 어머님의 유산으로 생각하셔서 생활비로 요긴하게 쓰시고요. 돌아가신 어머님도 IRS가 지급기준으로 인정하는 2018년도분 택스보고를 하셨으니 Stimulus Check를 받으실 자격이 있다고 봅니다. 혹여 나중에 IRS가 법적조항을 만들어 돌려달라고 하더라도 원금만 청구할 수밖에 없고 그 청구의 대상이 존재하지 않으므로 자발적 Return이 아닌 이상 회수가 어렵습니다.
How do you return a stimulus payment?
The IRS provided specific instructions for returning an economic impact payment (EIP) sent to a person who is dead.
If the payment was a paper check and it hasn’t been cashed:
Write "Void" in the endorsement section on the back of the check.
Mail the voided Treasury check immediately to the appropriate IRS location for your state.
Don't staple, bend or paper clip the check.
Include a note stating the reason for returning the check.
If the payment was a paper check and you have cashed it, or if the payment was a direct deposit:
Submit a personal check, money order, etc., immediately to the appropriate IRS location for your state.
Write on the check/money order made payable to “U.S. Treasury” and write “2020EIP,” and the taxpayer identification number (Social Security number, or individual taxpayer identification number) of the recipient of the check.
Include a brief explanation of the reason for returning the EIP.
