현재 보스톤에 온지 얼마 안된 사람입니다.
우선 제가 집을 계약하고 살고 있는데, 처음 계약할때 cosigner가 필요하다고 해서, 어떤 분을 통해 코싸인을 받았습니다. 근데 문제는 그 코싸인을 off 하는 관련해서 전문가의 의견이 필요합니다.
하지만 현재 그분이 off the lease 하고 싶으다고 하셔서, landlord에게 저의 bank statement를 증명할 자료를 줬고, 집주인도 알겠다고, 하며 메일로
***, you are officially release. (off the hook)
----- (집주인 이름)
이렇게 이메일로 받았습니다.
문제는, 코싸이너분께서는 자기는 official letter from the realty person 이 필요하다 하셔서 (he said whoever the landlord is), Realty group과 얘기해보니
realty 쪽에서는 아래와 같이 답을 보냈읍니다.
1. In Massachusetts cosigner forms are not publicly filed, unless they
are brought into court for many possible reasons. (not paying rent,
damages, etc)
2. ------ Realty Group and myself have no ownership of the property
you rented, therefore I or anyone from ----- Realty Group cannot sign
off on any paperwork relieving *** of any of his cosigner duties.
That is the landlords responsibility. The landlord has already
relieved *** of his duties as a cosigner via past email. There is no
reason ------- Realty Group should be involved in this matter. The
cosigner form is simply something we provide and it happens to have
our logo on it. We are an independent contractor hired out by the
landlord and yourself to facilitate the rental transaction for the
property you rented.
3. In Massachusetts emails, texts, and all letters can be considered
legal documents. Landlord sent you an email saying that *** is relieved
from his duties as a cosigner.
위의 내용은 다 맞는건가요??
이메일도 legal document로 다뤄지고,(집주인의 메일 끝에 그 사람 이름이 적혀 있긴 하지만 사인 같은건 없는데도, release 됬다고 하면 된건가요? )
realty 그룹은 상관이 없는건가요?
보통 개인이 소유한 집을 렌트한 사람의 코싸이너에 대해서는 아무대도 FILE하지 않는건가요?
코싸이너 분께서 걱정하시는 부분이 뭔지도 알거든요.
확실한 증거가 필요하신거죠.
