안녕하세요. 현재 F-1 학생 비자로 있는 유학생입니다. 2008년도에 OPT를 통해서 1년간의 employment authorization card (EAD) 를 발급 받았었는데요 이번에 시민권자 배우자를 만나 영주권 신청을 하게 되면서 I-765 을 작성중입니다. 참고로 작성중인 I-765는 가장 최신 버전입니다 (현재 uscis website에 올라와 있는 form)
1. USCIS에서 제공하는 작성시 instruction을 보시면 "Renewal EAD: An EAD issued to an eligible applicant upon the expiration of a previous EAD issued under the same category" 라고 나옵니다. 저의 경우는 과거에 EAD를 한번 발급 받았었지만 OPT를 이유로 발급 받았던 것이고, 지금 신청하는 것은 결혼을이유로 하는 경우 (카테고리 C.9)이기 때문에 신청 카테고리가 전혀 다르므로, renew 하는 것이 아니라 새로 신청하는 것으로 생각이 됩니다만. 맞습니까?
2. 현재 I-485와 I-765를 concurrent filing으로 같이 낼 계획입니다. 듣기로는 이렇게 같이 내게 될 경우, I-485 filing fee 이외에, 따로 I-765 filing fee는 안 내도 된다고 들었는데 사실인지요? USCIS에서 제공하는 institution에는 "If you filed Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, and you paid the Form I-485 filing fee, no fee is required to also file a request for employment authorization on Form I-765." 라고 되어 있으니 안 내도 되는거 같은데..맞는지 확인 부탁드립니다.
