주말 팟타임 광고에 있는 하루 일당이 맞는 것인지 궁금합니다.

주말 팟타임 서치하다 발견한 건데 wage  가 맞는건지 궁금해서 올려봅니다.

8 am ~ 9 pm (전후)

total  13 hours  - 1 hour (lunch) = 12 hours

8 hours * $ 9.00 = $72.00
4 hours * $13.50 = $54.00

total $126.00    mininum wage 로  계산해도  $126.00  인데  $120  준다는게 맞는건지 궁금합니다.

7월 1일 부터 california 의 minimum wage 는  $9 입니다. 

이 광고는  행사일과 관계없이 12월에도 계속 올라오는데  일당은 변함이 없네요.

    하루에 12시간 일했으면 8시간은 regular 4시간은 overtime 적용이 됩니다

    하루에 12시간이 넘으면 double time 적용됩니다

    Full time 으로 일하면서 주 40 시간 이상 일한경우에 그 40 시간을 했을경우 그 이상의 시간에 over time 이 1.5 배 로 계산해야되고
    거기에 하루에 12시간 넘으면 double time.으로 적용됩니다.
    주말에만 하루나 이틀 12 시간을 일하는 경우는 over time 도 아니며 더더욱 double time 은 아닙니다.  정상적으로 full time 으로 일하는.employee 가 아니기때문 입니다.

    Over time rate 은 먼저 주 40 시간을 일한뒤에 적용됩니다.  주 40 시간을 일하지않고 일주일에 하루 나 이틀 12 시간씩 일하는것은
    Over time 이라고 하지않읍니다.  그렇게 일하는것은 part time 으로일일한다고 하지요.

    확실하게 part time full time 상관없이 하루를 일하더라도 8시간이 넘으면
    overtime 12시간이 넘으면 double time 적용됩니다. 아래 법조항을 읽어보십시요

    원글님 혹시 하루 8시간 이상 일하시고 overtime 못받으셨스면 DSLE Form 1 으로 overtime 청구 받을수 있습니다. 유학생 이라도 신분 상관 없습니다. 참고로 저는 노동법 전문 Corp. Human Resources 오래 일해왔습니다.
